INDUSTRIAL PROPERTY LAW

(TRADEMARK-PATENT-UTILITY MODEL-DESIGN-GEOGRAPHICAL SIGNS)

Industrial property is a law regulating the rights such as trademark, patent, utility model, geographical signs, integrated circuit topography, plant breeders’ rights. Today "trademark" that protects distinctive signs in goods and services, "patent" that protects the invention, and "geographical sign" that shows the geographical origin of a product are keywords of economic growth.

The hundreds of billions of dollars worth of brands such as Apple, Coca-Cola, Amazon, General Motors, etc. are hundreds of times more than the material assets of companies. These examples are an indication of the importance of creativity, making inventions, whether to register a distinctive sign or not, to support product quality with the brand image, in short, industrial property.

At this point, “Forensis” gives seminars to clients and helps them understand the importance of industrial property in the light of the Industrial Property Law, which was renewed in 2017. As a matter of fact, using the registered trademark or a patent provides important legal gains according to the unregistered uses, the right to register and use a trademark or a patent.

To achieve the mentioned gains, trademark, patent, utility model, design, geographical sign, etc. are registered with the Turkish Patent and Trademark Office, appeal to the registration requests, appeal against the decisions of the Office, and application to the cases are being carried out. In addition, “Forensis” represents clients in conflicts such as parallel imports, trademark imitation, confiscation, unfair competition, protection of trade secrets.
